Amicus Curiae before the Constitutional Court of Colombia | María Luisa Rodríguez Peñaranda case

Constitutional Protection Action (Tutela) Filed by María Luisa Rodríguez Peñaranda against the Office of the Attorney General of the Nation and Others
Case No. T-10.639.278

The Coalition for Academic Freedom in the Americas (CAFA), together with the Human Rights Clinic of the University of Ottawa and the University of Monterrey (UDEM), submitted an amicus curiae brief to the Constitutional Court of Colombia in the case of Professor María Luisa Rodríguez Peñaranda. The document provides international and Inter-American standards on academic freedom to support the Court’s analysis of a constitutional protection action (tutela) concerning allegations of gender-based violence within a university setting and the right of access to justice.

The brief argues that academic freedom is a fundamental human right, closely linked to democracy, knowledge production, and the right to an education free from discrimination and violence. It further contends that the absence of a diligent investigation conducted with a gender perspective in cases involving complaints within higher education institutions can directly undermine academic freedom, affecting teaching, research, and full participation in university life.
